BIS issued a prepublication version of a Notice of Proposed Rulemaking this morning that would, absent a General or Specific Authorization, (1) prohibit Vehicle Connectivity System ("VCS") Hardware Importers from knowingly importing into the United States certain hardware for VCS; (2) prohibit connected vehicle manufacturers from knowingly importing into the United States completed connected vehicles incorporating certain software that supports the function of VCS or Automated Driving Systems ("ADS"); (3) prohibit connected vehicle Manufacturers from knowingly selling within the United States completed connected vehicles that incorporate covered software; and (4) prohibit connected vehicle manufacturers who are owned by, controlled by, or subject to the jurisdiction or direction of the PRC or Russia from knowingly selling in the United States completed connected vehicles that incorporate VCS hardware or covered software. The prohibitions would apply when such VCS hardware or covered software is designed, developed, manufactured, or supplied by persons owned by, controlled by, or subject to the jurisdiction or direction of the PRC or Russia. This is a very significant development that could impact not only Original Equipment Manufacturers but also their tiered suppliers depending on how the rules are applied. Careful review of the notice is required along with strong consideration for the submission of comments for those impacted.

BIS has published a Final Rule in today's Federal Register adding 123 entities under 131 entries to the Entity List. A wide range of destinations are captured including Canada, China, the Crimea Region of Ukraine, Cyprus, Iran, Kazakhstan, Kyrgyzstan, Russia, Turkey, Ukraine and the UAE. All of the entities have been added based on a determination that they are acting contrary to the national security or foreign policy interests of the United States.?Be certain that any screening tool being used has been updated to reflect this modification.

A great start to a full day of meetings in D.C. on behalf of the National Association of Foreign-Trade Zones (NAFTZ)! Kicking it off was a meeting with Troy Miller, the Senior Official Performing the Duties of the Commissioner for U.S. Customs and Border Protection, during which the NAFTZ Executive Committee and members of its Staff discussed the positive working relationship NAFTZ has with CBP and continued efforts to work collaboratively in support of the trade.
