Major developments are underway for businesses operating in, or handling the data of citizens of, Brazil. The nation with the largest economy in South America will begin enforcing new requirements regarding cross-border transfers of data of Brazilian data subjects. Absent an "adequacy decision" permitting cross-border transfers into the U.S. generally (which, as our relationship with the EU indicates, may take a long time to put in place), U.S. companies will need to review their existing contracts that deal with such data transfers to ensure they have appropriate contractual language as required by these new regulations.
