    On October 16, 2024, the U.S. Federal Trade Commission (FTC) finalized its “Click-to-Cancel” Rule, officially known as the Negative Option Rule. This rule impacts companies that use negative option marketing – a strategy where customers are automatically enrolled or billed for services unless they actively cancel. ?? What’s New? The rule requires companies to make it as easy to cancel a subscription as it was to sign up. If a customer signed up online, they should be able to cancel online without extra steps or complicated processes. It also, among other updates, prohibits misrepresentations of material facts and requires clear and conspicuous disclosure of material terms. The FTC has clarified that these requirements will not be limited to consumers; they will also apply to business-to-business transactions.
