The Minnesota Real Estate Journal Investment Summit was a not-to-miss event with panels full of the leaders driving investment in the broader CRE market. Onyx's General Counsel and Chief Risk Officer, Brad Heitzinger (Heitzinger, Brad), was a featured panelist focused on legal trends in commercial leasing. If you missed this event, don't worry; we pulled some pieces of wisdom that Brad shared so you can stay in the?know on lease trends in CRE: 1. Office users care about sustainability features:?Larger office tenants who are driving higher rents are looking for ESG features and landlord investment in health?and sustainability, tied to lease agreements. With the office market down overall, buildings with these?features are magnetizing tenants over owners who have been slow to consider these strategies. 2. Flexibility requirements for retailers:?Tenants still remember the chaos of the COVID shutdowns, and some press for clauses around acts of god or "dark/down" times, which add significant?risk for owners if allowed in leases. Instead of accepting this clause, best practices are to consider more flexibility around use within the space, allowing the tenant to adapt to produce revenue if the market adapts again. For example, Macy's recently acquired Toys-R-Us and is implementing mini toy stores in their larger footprints. 3. To-go parking remains a retail trend:?What started as a grocery retail trend has grown to be a typical feature for many retailers, including brick-and-mortar?shops. Most retailers look for a few dedicated to-go spots committed in their lease agreements to ensure they can service consumers who value convenience. 4. Small-bay industrial maintains high demand:?Onyx and Obsidian Group specialize in small-bay industrial acquisition, leasing, and development. In our market segment, there is incredibly high demand for the space and we don't tend to get much pushback around our triple-net-lease approach and standard terms. There is higher turnover in this market segment, but the demand/rates overcome that risk. 5. Broader industrial market considering Prologis Clear lease approach:?Prologis has been leading the market in considering their "Clear Lease" approach, which simplifies costs and responsibilities into a simpler, shorter lease agreement.
