In a recent Employment Law case, the insured voluntarily dismissed several claims until the final one was dismissed before trial. They refiled the entire action soon after, however the counterclaim proceeded to trial in the original action as the only claim heard. After losing the counterclaim, they moved to dismiss citing res judicata. This case serves as a reminder to avoid piecemeal dismissals that could complicate your case down the line.
