Last week, Federal Trade Commission Chairman Andrew Ferguson directed the agency to form a new “Joint Labor Task Force” that will focus on enforcing federal antitrust laws to protect competition in labor markets and consumer protection. This includes targeting unreasonable noncompete agreements, no-poach, non-solicitation, and no-hire agreements, and unlawful use of diversity, equity, and inclusion (DEI) metrics. Christine Bestor Townsend, Tobias E. Schlueter, and Zachary Zagger review the task force’s focuses and discuss next steps for employers: https://bit.ly/4iqtuTv #employmentlaw #unfaircompetition #noncompeteagreements?

Last week, the U.S. Supreme Court ruled that Alabama’s requirement to exhaust administrative processes before pursuing federal due process claims in state court unlawfully immunized state officials from claims for delays in unemployment insurance claims. The decision may pave the way for increased access to state courts for plaintiffs challenging administrative delays. A federal court in Maryland preliminarily blocked the Trump administration from enforcing executive orders that seek to eliminate DEI programs and initiatives in the federal government and private sector. The court found the executive orders are likely unconstitutionally vague, lack clear definitions, and potentially discriminate against certain viewpoints in violations of the First Amendment. Scott Kelly, Nonnie Shivers, and Zachary Zagger have the details: https://bit.ly/4kfgcL5 #employmentlaw
