Continuation of Plan Lawsuits—With the rise of more informed consumers due to Transparency in Coverage (TiC), plan members now better understand their rights and the health plan sponsors fiduciary duty to act solely in the interest of participants. I anticipate a continued rise in plan lawsuits over perceived imprudent spending, excessive fees, and opaque payment practices. 3... The Rise of AI Regulations—We have already seen several states including California, Illinois, and Colorado enact their own AI regulations. With the rapid adoption of Artificial Intelligence in healthcare, we should begin to see an evolving legal framework to attempt to maintain the balance of security and innovation. 2... Reemergence of The PBM Reform Act—This was introduced in 2023, and although it received bipartisan support, it did not advance. It’s an initiative we could likely see back on the table in the coming year. 1... Expansion of the No Surprises Act—The No Surprises Act was enacted during Trump’s first term and with recent bipartisan interest in strengthening the NSA’s enforcement, we may see an expansion to include increased clarity, regulation, and transparency.
