Two more big wins for O'Connor & O'Connor, Esqs. last week! Following a four-day jury trial, a Nassau County jury awarded judgment in favor of the client. Pursuant to a municipal town code, our client was responsible for maintaining a sidewalk as the adjacent property owner. After hearing testimony regarding the plaintiff’s alleged injuries after tripping and falling over a decorative brick on a sidewalk, the jury determined that the premises was reasonably safe. On a motion for summary judgment, a United States District Judge in the Eastern District of New York held that there was insufficient time for our client (store) to remedy a condition created by another customer and any alleged failure of its employees to follow a store policy was not a basis for negligence liability. On a motion for summary judgment, a Suffolk County judge held that the client was entitled to a dismissal of all claims against it as it did not exercise control over the Suffolk County parking lot in which the plaintiff was allegedly injured. Following a three-day jury trial, an Orange County jury awarded judgment in favor of the client, finding that the client did not exercise control over the Orange County parking lot in which the plaintiff was allegedly injured.
