Better hurry if you don’t want to miss Local Law 97’s first deadline! Emission reports for NYC’s largest buildings (most buildings over 25,000 square feet are required to meet new greenhouse gas emissions limits) are due in 100 days. Potential penalties for missing the deadline include up to $268 for EVERY metric ton of carbon dioxide your building emits above the cap set for its building type. So don’t delay and make sure you get those reports in on time! In New York City, over two thirds of greenhouse gas (GHG) emissions come from buildings and under this groundbreaking law, the goal is to reduce the emissions produced by the City’s largest buildings 40 percent by 2030 and to net zero by 2050. LL97 compliance reports are due on May 1, 2025, and the law allows for a 60-day grace period to file these reports. For Article 320 buildings required to submit an annual emissions report, failing to file by June 30 will result in a monthly penalty of $.50 x the square footage of the building. For a 25,000 square foot building, this means a $12,500 monthly penalty for each month following May 1 that the report has not been filed. At the close of the 60-day grace period, a 25,000 square foot building will already be subject to a $25,000 penalty. ? A building owner can apply to extend the reporting deadline to August 29, 2025, in the event the owner’s registered design professional (RDP, for Article 320 buildings) or retro-commissioning agent (RCx agent, for Article 321 buildings) could not complete the report by June 30. ? The deadline for building owners that were seeking to apply for an extension to submit LL97 Compliance Reports must have hired a registered design professional (or retro-commissioning agent for Article 321 Buildings – certain affordable housing and houses of worship) was February 1, 2025, which has since passed. ? There is a one-time requirement for the first year of LL97 filing* to verify each building's GFA. To apply for an extension must hire a registered professional by February 1 and submit an affidavit explaining why your report will be delayed. Missing the deadline or failing to get an extension could result in financial penalties, so don’t delay and act today!
