Congratulations to Stephen A. Berrios, Kristine S. Phillips, and law clerk Antonio Zuniga for obtaining summary judgment for their client in the Circuit Court of Cook County last week! Our astute attorneys defended against a former employee’s claims that alleged the employer breached the employee handbook and intentionally caused severe emotional distress, when the employer responded to plaintiff’s coworkers circulating a petition asking for plaintiff to be terminated for inappropriate racism and bias. After initially obtaining a dismissal with prejudice for defamation and negligence causes of action at the pleading stage, the court then agreed with the arguments presented for the employer on summary judgment and found that the employees engaged in a protected activity and that the response was a reasonable exercise of business judgment. ? In recent federal district Court rulings, a spotlight has been put on the requirement for trade secrets plaintiffs to adequately identify their asserted trade secrets at summary judgement and trial. A federal court in Texas has struck down the FTC’s rule banning non-competes, finding that the FTC lacks rulemaking authority. The court’s ruling comes out of a suit filed by Ryan LLC, a tax service firm in Dallas, arguing that the rule would inflict “serious and irreparable injuries” on its business buy putting its confidential information at risk and allowing competitors to freely solicit its employees. The suit was joined by several other organizations, including the U.S. Chamber of Commerce, Business Roundtable, and the Texas Association of Business. ? The FTC, which has long opposed non-competes, has said that it is “seriously considering” an appeal. ? While the court’s ruling prohibits the sweeping prohibition proposed by the FTC, it does not prevent challenges to individual non-competes on a case-by-case basis. https://lnkd.in/g8SHFfm2
