H.R. 9495 Action Update The U.S. House voted this morning to pass H.R. 9495, the “Stop Terror-Financing and Tax Penalties on American Hostages Act.” As we wrote yesterday, this bill will grant the Secretary of the Treasury the authority to revoke the tax-exempt nonprofit status of any organization deemed a supporter of terrorism with minimal due process and without disclosing evidence. The burden of proof would be on the nonprofit to disprove any allegations of terrorism. While it is unlikely the bill will be brought up to the Senate in its present form before the 118th?Congress adjourns, it will likely be reintroduced in the 119th?Congress and passed into law. We know this is a time of great concern for a lot of the sector and the communities we serve. The bright spot is the vote that passed today had less Representatives voting yea (53 two days ago versus 15 today), so your calls do work. NAO will continue to advocate for the sector, and we promise to try to scan for and get information to you as soon as we can, along with actionable items and steps you can take. Judge Blocks FLSA Overtime Rule Last week, a Texas federal judge ruled to strike down a Department of Labor (DOL) overtime rule that would have expanded the number of workers eligible for overtime pay under the?Fair Labor Standards Act?(FLSA), starting on January 1, 2025. The judge also overturned the initial increase under this rule that went into effect on July 1. As a result, the salary increase that was scheduled to commence on January 1, 2025 is unlikely to take effect. Why does this matter? This ruling means that nonprofits, along with other employers, are not required to follow the anticipated increased salary threshold of $1,128/week ($58,658/year) for overtime eligibility. The threshold is set to revert to the level it was before July 1, 2024, requiring employees to earn at least $684 per week ($35,568 annually) to qualify as an exempt employee. What a BEAUTIFUL day. 12 hours of shooting in three different cities up and down the valley and out to the coast to finish out the NAO x Heart Nonprofit PSA video, releasing December 3rd. This will be a free marketing asset to all Oregon Nonprofits that reminds people of the important work they do and asks donors to give. We could not have gotten luckier with the weather, the people, and the opportunities for beautiful, compelling footage to catch the attention of your donors. HUGE ANNOUNCEMENT: The Nonprofit Association of Oregon (NAO) and Heart Brand Stories are teaming up to create a shareable PSA on behalf of ALL NONPROFITS IN OREGON reminding everyone of the important work they do, and encouraging donors to prioritize their local Nonprofits as they approach the end of their fiscal years. This PSA video will be distributed via local broadcast channels, news organizations, and social media channels across the State of Oregon. It will be given freely as a marketing asset to all Nonprofits in Oregon. It will be released on December 3rd, 2024 (Giving Tuesday). The team we've pulled together to produce this piece is incredible, and the ability to produce it alongside such an incredible organization like NAO with Jennifer Monegan at the helm is definitely a pinch me moment.
