Retainer agreements form the foundation of the attorney-client relationship and are key to setting expectations and protecting against liability. Thanks to the NJSBA’s advocacy, New Jersey attorneys now have guidance to assist in drafting arbitration provisions in their retainer agreements. The Supreme Court’s guidelines, heavily inspired by NJSBA the recommendations, provide model language for retainer agreements and clear direction for how attorneys should explain potential arbitration so that clients can make an informed decision.
