Last week, I had the privilege of attending the Sanctions, AML, Anti-Corruption, Compliance, and Ethics Conference organized by Nielsonsmith Ltd. in partnership with Middle East & Africa Compliance Association and the Compliance Society of Kenya The focus? Addressing Kenya's FATF Grey Listing challenge and the path to getting de-grey listed. So why should you care about Grey Listing? Well, being on the grey list means increased monitoring and scrutiny from global financial institutions, making it harder for Kenyan businesses to: 1.Attract Foreign Investors 2.Access International Banking & Trade So what's the path forward? 1.Embedding Compliance in Corporate Culture – Compliance should not be an afterthought. It must be integrated into daily business operations. Everyone in an organization should understand why compliance matters. 2.Keeping compliance simple and practical, especially for small businesses that may lack dedicated compliance teams. 3.Engage with regulators – The private sector must play an active role in engaging regulators by participating in training and regulatory dialogues. 4. AI & Compliance Tech Are the Future- AI driven automation can simplify processes, enhance risk assessments, and improve regulatory reporting. Kenya’s grey listing presents both challenges and opportunities. While it demands stricter compliance measures, it also pushes businesses to adopt global best practices which, in the long run, will strengthen Kenya’s financial ecosystem. For startups and SMEs, the key takeaway is clear: Compliance is no longer optional—it’s a competitive advantage.
