Veto day is coming next Thursday October 10th. Two items need your urgent attention. Encourage your State Rep and Senators to leave HB1633 (the state takeover bill) ON THE TABLE. Encourage your Senator to Override the Governor’s veto of HB1518. This bill would allow the medical ATCs to cultivate in outdoor greenhouses with approval from DHHS. Override Veto of Medical Cannabis Bill Lawmakers will meet on Oct. 10 for “Veto Day.” One vetoed bill that needs to be overridden is HB 1581. HB 1581would allow alternative treatment centers (ATCs) – therapeutic cannabis dispensaries – to operate additional cultivation locations, including greenhouses, with approval from the Department of Health and Human Services. The greenhouses would have to meet the same security rules as the indoor grow facilities now used by the ATCs. Indoor grow rooms, currently required under State law, are totally dependent on electricity and fossil fuels for heating, cooling, ventilation and water circulation. Greenhouse production would allow ATCs to use much less energy, while producing medical strains with unique properties, such as higher levels of terpenes and other beneficial compounds. Cost savings could be passed on to patients. There also may be an effort to resurrect the failed State monopoly bill on Veto Day. HB 1633, as amended by the Senate, would have handed $18 million to the NH Liquor Commission, for them to take over the cannabis market in NH. This bill would limit free enterprise and be bad for farmers and consumers. HB 1633 died, and it should not be brought back to life, because we have a chance to pass a great bill during the next legislative session. HB1633 Officially a Zombie Bill? Possible Effort to Bring it Back to Life on Veto Day. It’s baaaaaaack…maybe. For those that may not recall, the ultimate result of votes on the state takeover bill during what is called Crossover Day ultimately ended with the bill being tabled in the House. For those catching up, you can read our previous analysis here, here and here. I’m sure you were hoping (as we were) that it would be the end of the bill, and hopefully the end of years of attempts for the state to be too involved in the industry rather than constraining itself to a regulatory role. Well…for a few weeks at least we have been hearing rumors there may be a concerted effort to un-table the bill and pass it at Veto Day happening on October 10th 2024. We’ve been holding off until we could get some sort of collaboration. Currently we’ve received enough tips from various sources that we feel there is enough smoke to send out a warning. If you want any chance at opportunity to compete in the industry we’d recommend contacting your State Rep and Senator early and often. Yesterday was primary day in New Hampshire. Unfortunately the fight for cannabis legalization took some hits. Senator Gannon won his primary over Emily Phillips and Rebecca McWilliams lost hers. These would have been two crucial candidates to send into the general election to potentially change the complexion of the NH Senate. Want to know where the candidates for Governor stand on legalizing cannabis in NH? So did we! So we invited all NH gubernatorial candidates to join us for a candid discussion. The biggest difference for us? Probably thoughts on the structure of the industry and the involvement of the Liquor Commission. Take a gander and mark your calendar to get out and vote! Jon Kiper Prefers free market but OK with state run models if that is what it takes to pass legalization. OK with liquor commission running stores but didn’t believe they should be any more involved in other aspects of the industry. OK with controls on the number of business entities. Sole focus on funding affordable housing solutions with tax revenue. Supportive of consumption lounges in the future. Not a believer it is a supply side issue nor that consumption rates would necessarily change. Cinde Warmington Past advocate for decrim as well as legalization as chair for NH Democratic platform committee. History of working with small farmers in NH and supportive of opportunity for them. Open to outdoor grows. No conclusions on structure of the industry but open to input. Not in favor of 15 store limit on dispensaries. Joyce Craig Very clear about not wanting the Liquor Commission involved in the industry. Did not support the state run model. Favors smaller business and entrepreneurs and local owners. Favors structure that dis-incentivizes large or multi-state operators. Noted Vermont’s structure as a model to learn from.
