NJCJI was on the winning side of a very important New Jersey Supreme Court decision regarding the retroactive application of New Jersey's Wage Theft Act. The Court's reasoning for rejecting retroactive application of that law borrowed heavily from the arguments that NJCJI made in its amicus brief in support of the defendant. This unanimous decision is a huge win for employers in New Jersey.

Last month, NJCJI testified in opposition to a purported "Green Amendment", which would provide a state constitutional right to a clean and healthy environment. While seemingly well-meaning and harmless, the Green Amendment could easily turn into a lawsuit juggernaut by allowing environmental advocates to mount endless litigation campaigns to support their policy goals. This would completely undermine long-standing legislative and regulatory processes, which provide all stakeholders an opportunity to participate and be heard.

Last month, NJCJI and the U.S. Chamber of Commerce helped obtain a favorable decision from the New Jersey Supreme Court for New Jersey retailers. This decision will prevent consumer class action lawsuits against them when no actual loss occurred. NJCJI thanks Jeffrey S. Jacobson, Esq., national co-chair of the class action practice at Faegre Drinker, for his written and oral advocacy on behalf of NJCJI and the U.S. Chamber of Commerce in this matter.
