“While it is difficult to tell how the Court will ultimately rule, the questions posed show that the Court appeared to be equally divided,” Nashville partner Shane Ramsey explained in a Pratt’s Journal of Bankruptcy Law article regarding a case pending before the U.S. Supreme Court where the Court will decide whether a bankruptcy trustee may avoid a debtor’s tax payment to the United States under Section 544(b) of the Bankruptcy Code when no actual creditor could have obtained relief under the applicable state fraudulent transfer law outside of bankruptcy. Ramsey continued, “Indeed, other high court commentators seemed to agree, with one stating that the ‘justices seemed divided during oral arguments,’ and other observing that ‘[f ]or the most part, the justices seemed unsure about which way to turn. . . . This sounds to me like a case in which the justices had read the briefs but formed so few strongly held predispositions that they were pretty much completely undecided coming into the argument.’”

While the AIA A201-2017 General Conditions provide a widely used industry standard, construction loan agreements often impose additional obligations or conflicting provisions that can disrupt a project. Appellate attorney Jeffrey Wald authored an article on the cover of the March/April 2025 edition of The Florida Bar Journal examining the Supreme Court's shift away from the Warren Court's?Trop v. Dulles?(1958) "evolving standards of decency" test for the Eighth Amendment, replacing it with a history-and-tradition approach, as seen in?City of Grants Pass v. Johnson?(2024). "It seems safe to say that the Supreme Court will not rely on?Trop?to reverse a punishment any time soon (if ever again). Although criminal defendants can — and probably should — continue to make evolving-standards-of-decency arguments before the lower courts, they would be wise also to make history-and-tradition arguments," Wald writes. "In those rare cases when the Supreme Court takes up an Eighth Amendment challenge, litigants should dust off their history books and put away those glossy contemporary statutory codes, because it is historical practice — not the combined action of present-day state legislatures — that is likely to sway the Court."
