Here is what we know: Relatives who participated in the prayer walk and were targeted have been recently found guilty of the exact charges that Andrew and Gene are up against. Their charges include criminal case proceedings for “Standing on a highway with intent to impede/stop traffic”, a Class 1 Misdemeanor. Punishable by one year imprisonment in a county jail, a two-thousand dollar fine, or both. We are battling racism at the local, state, and federal levels in South Dakota, and the police are actively targeting our relatives, organizers, leaders, and comrades.?Meanwhile, city officials are finding various mechanisms to expedite and locate resources to build more prisons locally, something the community has actively opposed. UPDATE–The latest SB 83 bill takes effect on July 1st. It reduces charges for ingesting a controlled substance from a felony to a misdemeanor for the first two offenses and includes treatment options as part of probation. We want to thank the countless community advocates who pushed for the enactment of South Dakota Senate Bill 83. The prior law disproportionately impacted Indigenous peoples’ and created lifelong burdens of a felony conviction, which further oppressed Indigenous people in South Dakota. In South Dakota, Indigenous peoples’ make up less than 10% of the population; however, we make up close to 50% of the prisons and jails. This updated law takes steps to humanize the approach to addiction and is a win for all of South Dakota, especially Indigenous citizens. ?? “On Jan. 27, the Trump administration’s Office of Management and Budget issued a memo that temporarily paused all federal financial assistance. The move has been held up in court ever since, leaving the future of federal funding in limbo. But the NDN Collective has refused to be frozen.
