Yesterday, Human Rights First joined National Immigration Litigation Alliance and Northwest Immigrant Rights Project in filing a national class action lawsuit on behalf of four individuals with final removal orders in federal district court in Boston, Massachusetts. The lawsuit challenges the Department of Homeland Security’s policy of deporting noncitizens to countries the government never raised as possible countries of removal during their immigration proceedings, without any notice or the opportunity to contest removal due to a fear of persecution, torture, and even death if deported. The lawsuit also challenges a secret directive instructing DHS officers to review the cases of individuals previously released from immigration detention—including those who have complied with the terms of their release for years and even decades—for re-detention and removal to a third country. Our 2025 grantees have been hard at work, advancing critical litigation to protect civil rights, environmental justice, immigrant rights, and fair elections. Each quarter, they submit updates on their cases, and we’re proud to highlight the impact of their work so far. Here are key takeaways from Q1: A Better Childhood Challenging Alaska’s foster care system for violating the rights of over 3,000 children, particularly Native American children, by failing to provide stable placements and necessary services. The case is moving toward trial in May. CENTER FOR PUBLIC REPRESENTATION Fighting for Medicaid-enrolled children in Georgia to receive legally required mental health services, preventing unnecessary institutionalization. The case is in early litigation stages, with a motion to dismiss pending. Our Children's Trust Representing young Alaskans in a lawsuit to stop a massive fossil fuel project that would triple the state’s emissions. The court is expected to rule on a motion to dismiss by April 15, 2025. National Immigration Litigation Alliance Leading a nationwide class action to enforce Temporary Protected Status (TPS) applicants’ rights to work permits while waiting for USCIS adjudication. A decision on summary judgment is pending. Upper Seven Law Challenging Montana’s redistricting plan for discriminating against voters based on political beliefs. After a trial in December, the court is now reviewing post-trial arguments before issuing a final ruling. On average, each grantee dedicated 434 hours of attorney time this quarter, valued at $245,389.01– a testament to their commitment to justice. I could not be prouder of the work Annelise Maia Jatoba de Araujo and I did to bring about a great decision from the First Circuit Court of Appeals in Rosa v. Bondi. The government must prove that everyone in removal proceedings is in fact a foreign national; it's a jurisdictional fact. Yesterday the First Circuit agreed with our arguments that the government can put forth nothing less than evidence that is clear, unequivocal and convincing. A great win for due process! Also, we could not do the work we do without the ever-patient support of the National Immigration Litigation Alliance. Please give them lots of money.

I want to share a win I am very proud of! Rosa v. Bondi (1st Circuit) I and my firm won a major case before the First Circuit Court of Appeals, and from now on the burden of proving a respondent is an alien has to be done by clear unequivocal and convincing evidence which is a higher burden than just clear an convincing. Woooohooooo! So proud of our team at Araujo & Fisher, LLC!!!! Stefanie Fisher-Pinkert and I so grateful to all that have helped us! https://lnkd.in/gaBQ5R6w Bardis Vakili and NILA prevail against a government motion to dismiss; the events described in this lawsuit occurred in 2020: "Soon after the birth of their children, who are U.S. citizens, the mothers say they were quickly taken out of the hospital — sometimes only a day after giving birth — without their children’s birth certificates, reunited with their children at the hospital’s entrance, driven to the U.S.-Mexico border, and then told to walk across a pedestrian bridge to Tijuana."
