Founded in 1969, the National Health Law Program protects and advances the health rights of low income and underserved individuals. NHeLP advocates, educates and litigates at the federal and state level. Our lawyers and policy analysts stand up for the rights of the millions of people who struggle to access affordable, quality health care. We are guided by the belief—a challenge—that each generation should live better than the last. Health care reform offers the opportunity to substantially reduce the number of uninsured and improve access to care, including through the law’s expansion of the Medicaid program. Political and economic challenges, however, threaten these advances for millions of low-income and uninsured people. NHeLP defends the nation’s health care safety net for those most in need and those with the fewest resources. We fight to give at-risk populations a voice in federal policy making, promote the rights of consumers in emerging managed-care systems, and advocate for creative solutions that preserve the government’s responsibility as the provider of last resort. We are a force in the courtroom, working to ensure that low-income people and underserved communities can obtain the quality care to which they are legally entitled and holding state and federal Medicaid agencies accountable for their programs. The Republican-led Congress is threatening deep Medicaid cuts to fund President Trump’s plans for tax cuts and border security. At stake is health care coverage for about 80 million poor and disabled people, including millions of children. A broad coalition of hospitals, governors and consumer advocates are calling on Congress to spare Medicaid. Slashing Medicaid funding would hit California hard, especially immigrant residents. A number of President Trump’s executive actions severely threaten the future of sexual and reproductive health care access and equity. Some rescind Biden-era orders and others establish new policy priorities and issue agency directives. Important to note, however, executive orders do not change federal law or regulations. They outline the administration’s priorities and direct federal policy makers to take certain actions. Many advocates have already challenged various recent executive orders by filing lawsuits in federal courts, resulting in several injunctions. Yet, the chilling effect of these orders cannot be understated as people try to navigate through fear and confusion about what is or is not legal today and what will require additional actions (e.g., rulemaking) to take effect. Below is an overview of how executive orders (EOs) that President Trump has issued during the first weeks of his administration impact sexual and reproductive health care access for low-income and underserved communities. Work requirements are one of the most insidious strategies to cut Medicaid because they do so by triggering coverage losses rather than changing the structure of federal Medicaid financing. Cutting health insurance for millions through Medicaid work requirements would profoundly hurt state and local economies. Work requirements would gut already strained state budgets, endanger state credit ratings, and destabilize the low-wage and health care workforce. Resulting coverage losses would increase uncompensated care at hospitals, clinics, and other providers, narrowing operating margins and risking closures, especially in rural communities.
