Rochester Roofing Company Penalized for Serious Safety Violations A judge has affirmed two serious OSHA violations against Elmer W. Davis Inc., a Rochester commercial roofing company, following a 2022 investigation. The violations included exposing workers to a 40-foot fall hazard and allowing the use of unsafe ladders during roofing work on the Village of Newark's municipal building. The company was ordered to pay $16,782 in penalties after the court rejected defenses claiming the violations were unpreventable or infringed on constitutional protections. “Falls are the leading cause of death in construction, and violations like these put workers in unnecessary danger,” said OSHA Area Director Jeffrey Prebish. The Bureau of Labor Statistics (BLS) released the 2023 Employer-Reported Workplace Injuries and Illnesses Data. The Key Highlights: ? Private industry employers reported 2.6 million nonfatal workplace injuries and illnesses in 2023, down 8.4 percent from 2022. This was driven by a 56.6% drop in illnesses (see photo below). ? In 2023, the incidence rate of total recordable cases (TRC) in private industry was 2.4 cases per 100 full-time equivalent (FTE) workers, down from 2.7 in 2022. ? Injuries occurred at a rate of 2.2 cases per 100 FTE workers, down from 2.3 in 2022. ? The incidence rate of illnesses decreased in 2023 to 19.0 cases per 10,000 FTE workers, from 45.2 in 2022. ? Respiratory illnesses occurred at a rate of 9.5 cases per 10,000 FTE workers in 2023, down from 35.8 in 2022. ?There were 946,500 nonfatal injuries and illnesses involving days away from work (DAFW) in 2023, 20.1 percent lower than in 2022.
