"The Devil is in the Details: A Practical Look at First Amendment Challenges Arising from Conflicts between University Requirements and Students’ Religious Beliefs" by Cliffton Jacques ? The postsecondary setting has long served as a space where religious views of students are expressed, challenged, and litigated. Despite the existence of longstanding precedent in some of these areas of the law, institutions continue to find themselves susceptible to students’ constitutional challenges for failing to alter their policies or practices in the face of an individualized religious objection from a student. This continued vulnerability appears to stem from the nuance required to apply these analyses to the unique facts of any one request or practice. The difficulty increases when one considers the evolving social landscape of religious objections that have emerged in recent years including those stemming from COVID-19, discussions of sex and gender identity, and the increasingly muddled lines between religious, political, and moral objections. In other words, the devil is often in the details. This NACUANOTE serves as a practical guidance document for university counsel and college administrators who encounter religious objections and accommodations requests on campus. Since taking office in January, the Trump administration has issued Executive Order 14151 (“Ending Radical and Wasteful Government DEI Programs and Preferencing”) and Executive Order 14173 (“Ending Illegal Discrimination and Restoring Merit-Based Opportunity”). Additionally, the February 14th Dear Colleague Letter directs institutions to end programs related to diversity, equity, and inclusion. In response, several lawsuits have been filed challenging the Executive Orders and Dear Colleague Letter. On February 21, 2025, a federal judge issued a preliminary injunction blocking several provisions of the Executive Orders. NEW NACUANOTE! "The Stop Campus Hazing Act Amendments to the Clery Act" by Andrea Stagg and Joseph Storch ? In December 2024, Congress passed and the President signed the first amendments to the Higher Education Act’s Clery Act requirements since the 2013 Reauthorization of the Violence Against Women Act. The Stop Campus Hazing Act (“SCHA” or “the Act”) adds new definitions for the terms “hazing” and “student organization,” includes hazing as a new section to report in future Clery Act Annual Security Reports (“ASR”), adds hazing policy statements and prevention training requirements, requires publication of Campus Hazing Transparency Reports (“CHTR”) for certain findings of organizational responsibility for hazing, and slightly renames the Clery Act. This NACUANOTE summarizes these changes and offers analysis connecting the new requirements to longstanding elements of the Higher Education Act.
