Legislation was proposed in the State of Maryland to address alleged “Zombie” Mortgages. The proposed legislation provided that if no payment has been made for 5 years, periodic statements must be sent for twenty-four (24) months prior to filing a foreclosure.?There is a distinguishment that prior to October 1, 2027, a lender must have sent 10/1/2027 you have to have sent “loan-related correspondence” during each billing cycle for the last 24 months OR a notice 90 days prior to docketing in addition to the Notice of Intent to Foreclose 45 days prior to docketing.?Additionally, the proposed legislation specifically provided that if no payment has been made within five (5) years the borrower may raise a Laches defense.?The proposed legislation did not provide for any deadline for the borrower to raise the defense and further provides that upon raising a Laches a Defense the Court may “Order any relief the Court considers to be appropriate.” Fortunately, the legislation was “killed” in the Senate.?As a result, we no longer need to worry about this issue for now. Unfortunately, this is still a central issue raised in many litigated files. We will continue to vigorously defend our clients as it relates to this issue and are pleased that the matter is no longer subject to legislation in Maryland at this time.
