Does bad behavior in a marriage influence custody decisions? In California’s no-fault system, the answer is generally no – custody rulings are based on the best interests of your children, not marital misconduct. That said, courts will intervene if a parent’s actions create an unsafe or unstable environment for the child. Behaviors that can impact custody arrangements include: – Domestic Violence or Abuse – A documented history of violence towards an intimate partner or child can result in restricted or denied custody rights. – Substance Abuse – If a parent struggles with drug or alcohol addiction in a way that affects their caregiving ability, courts may order supervised visitation or require proof of sobriety. – Neglect or Absence – A parent who’s been largely uninvolved in their child's life or has a history of neglect may receive limited custody rights in favor of the more present parent. – Parental Gatekeeping– If one parent actively works to turn their child against their co-parent or interferes with visitation rights, the court may adjust custody rights to protect the child's relationship with both parents. California courts favor joint custody whenever possible, as children typically benefit from maintaining strong relationships with both parents. Domestic violence doesn't just leave emotional and physical scars – it can also create financial hardship and long-term economic challenges for survivors. In California, family courts recognize the profound impact abuse can have on financial stability, and survivors may be entitled to greater financial protections during divorce proceedings. How does domestic abuse affect spousal support? California courts take domestic violence into account when determining spousal support (alimony). Courts may deny or reduce alimony requests from an abusive partner based on their history of violence and its impact on the survivor’s well-being. Because abuse often leads to financial dependence and career disruptions, survivors may receive higher or longer-term support to regain stability. Psychological harm from abuse can impair earning capacity, leading courts to award additional financial support. How does domestic violence affect property division? While California typically follows community property laws, courts may deviate from a 50/50 split when domestic violence is involved. For example, if the abusive spouse controlled finances or engaged in reckless spending, the survivor may receive a larger share of assets. Courts will take into account any deliberate depletion or concealment of marital property by the abusive spouse, and potentially order additional resources for therapy, relocation, or career building for the survivor, which can impact asset distribution. When it comes to domestic violence, a “fair” settlement is not always a 50/50 split. Survivors deserve a legal strategy that advocates for their long-term security and well-being.
