Once again this year, and for almost a decade now, our very own Micaela Modiano has been sharing her expert knowledge through a lecture as part of the course conferring the European Patent Litigation Certificate. Micaela’s lecture focused on substantive law and case law on patents and SPCs at the Unified Patent Court and at the Court of Justice of the European Union. Micaela Modiano reported that on November 22, 2024 the Court of First Instance of the UPC (local division The Hague) has issued a decision setting forth an equivalence test in the form of 4 questions that need to be answered to determine whether there is infringement by equivalence. The questions are (bold present in the original): "i. ?????????????????? ??????????????????????: does the variation solve (essentially) the same problem that the patented invention solves and performs (essentially) the same function in this context? ii. Is extending the protection of the claim to the equivalent proportionate to a ???????? ???????????????????? ?????? ?????? ???????????????? in view of his contribution to the art and is it obvious to the skilled person ???????? ?????? ???????????? ?????????????????????? how to apply the equivalent element (at the time of infringement)? iii. ???????????????????? ?????????? ?????????????????? ?????? ?????????? ??????????????: does the skilled person understand from the patent that the scope of the invention is broader than what is claimed literally? iv. Is the allegedly infringing product ?????????? ?????? ?????????????????? over the prior art?" In its decision, the UPC states that the above test is based on the practice in various national jurisdictions. If all questions are answered in the affirmative, then there is infringement by equivalence. We are pleased to report that a delegation of the EPO Boards of Appeal has visited the UPC Court of First Instance in Paris, France on November 7, 2024. Given the potential intersection of the role of the EPO and of the UPC when it comes to the validity of European patents, this meeting represents a most welcome sign of the EPO's and UPC's efforts to reinforce their crucial importance in the field of European patent protection. Let's hope that this is just the first of many equally fruitful and productive meetings.
