Associate Hassan Shaikh recently authored an article published by the Daily Journal about State Pharmacy Benefit Management legislation following CA Governor Gavin Newsom’s veto of Senate Bill 966. Hassan writes, “Crucially, the veto of Senate Bill 966 gives the state legislature a remarkable opportunity to observe real market effects and efficacy of comparable measures in Other States before undertaking the significant task of refining and implementing such a measure in the nation's most populous state. The state legislature has a duty to take this opportunity seriously, especially if its prime objectives are genuinely to control prescription drug costs and increase consumers' access at the pharmacy counter.” Read the full article here: https://bit.ly/3YufSiY

Member Paul Huston was quoted by WIPR - World IP Review in an article about how ATS Tree Services dropped its lawsuit against the FTC over the agency's controversial non-compete ban. Paul said that the dismissal was tactical: "The plaintiff’s decision to dismiss is likely “strategic” to avoid conflicting with 'the national litigation plan' challenging the FTC’s ban on non-compete clauses, said Huston. He noted the success in both Ryan and Properties of the Village v FTC, where a Florida federal court also issued an injunction against the rule. Given that these litigations were proceeding 'favourably', Huston noted that it was likely that ATS 'stepped aside here to avoid giving the FTC positive precedent to rely on in future litigation.'" A team of our lawyers won a motion for summary judgment for client Horizon Tower in its case against Park County, Wyoming. In February 2023, the Park County Commissioners denied a request for Horizon to build a new cell tower in the Wapiti Valley area at the eastern entrance of Yellowstone Park. The consequential lawsuit brought by Horizon claims the County violated the Federal Communications Act in denying a permit to build the tower. In its recent order, the US District court ruled in Horizon Tower’s favor on all claims and required the County to issue the permit for the tower within seven days. The Mintz team included Member and Chair of the firm’s Communications Infrastructure Litigation Practice, Scott Thompson, and Associates Jonathan Garvin, Alain Mathieu, and Janki Viroja.
