Proud and honored to have represented the MidAtlantic IADA members and ALL independent auto dealerships at the National Independent Automobile Dealers Association - NIADA Policy Conference in Washington DC last week. We met with MD and PA Senate and Congressional offices to present our position on multiple pending bills in both houses: - the "Right to Repair Act" (HR 906) and "SMART Act" (HR 1707) restricting manufacturers' ability to control access to affordable parts/repairs by the consumer, restricting overarching control of the ECM in consumers vehicles allowing consumers to choose their own repair facility or complete necessary work themselves, removing the manufacturers' embedded programming restricting the use of suitable aftermarket replacement parts and easing the ability for non-nameplate dealerships or mechanics to access/reset and ECM or BCM as necessary without paying a premium to the manufacturer. - the "PART Act" (HR 621/S154) which would assist law enforcement in combating catalytic converter theft nationwide. PA already has enacted an aggressive bill, with the responsibility falling on recyclers and salvors to maintain and vet all "cats" processed or received. Unfortunately, adjoining states do not have similar laws in place as of yet - incentivizing the theft and transport out of state. This Federal bill would make similar provisions to PA'S law, in addition to requiring manufacturers to add "cats" to the list of the other eighteen (18) vehicle parts required to be traceable. - the "FTC REDO Act" (HR 7101/S3014)... this is THE MOST IMPORTANT... the passage of this bipartisan bill would STOP THE FTC "CARS RULE" and require the FTC to follow EXISTING regulatory safeguards (for both business and consumer interests) should the agency choose to "redo" the rule and deny the FTC funding to enforce the rule. [Note - the FTC's press release stated that they voluntarily stayed enforcement action until judicial review of the CARS Rule was complete, however complaints filed against dealerships and fined levied since the original effective date of 30.July.2024 demonstrate otherwise.] Because of the appropriation bill timing, we were pleasantly surprised to have the opportunity to speak extensively with Rep. Daniel Meuser. We are looking forward to staying in touch with each of the Legislators and continuing our communication through the next NIADA National Policy Conference to advance the interests of all independent dealers, repair facilities and salvors!
