Successful defense verdict in a jury trial of a homeowner liability case! Messner Reeves LLP Orange County Partners Craig Humphrey and Aaron Soleimani, Esq. successfully argued on behalf of the defense, an insured homeowner being sued for damages in a slip and fall case. Of Counsel James Randall handled all of the motions in limine, as well as pre-trial law and motion matters including a motion for summary judgement which eliminated half of the plaintiff’s case and punitive damages. Messner Reeves LLP Associate Sejal Patel, Esq. recently published a discussion of the assumption of risk doctrine in the “Barristers Tips” section of Los Angeles Lawyer Magazine. In the article, Sejal explains how the assumption of risk plays into defense when a plaintiff was injured while enjoying an activity for enjoyment or thrill, or requires physical exertion. “When the doctrine applies, the plaintiff’s assumption of the risk acts as a complete bar to liability,” she says.
