The District of Arizona recently dismissed a pro se litigant’s claims against a mortgage servicer for alleged violations of the FDCPA, reasoned the complaint had zero plausible basis in common and statutory law. This case should remind lenders that pro se plaintiffs often misread statutes and routinely misinterpret not only who or what can be defined as a “debt collector” or “debt collecting activity” under FDCPA, but also what is a viable claim under TILA. The EPA’s Superfund Program is a cornerstone of U.S. efforts to remediate contaminated sites and protect public health. The Superfund Program under President-Elect Donald Trump’s second term can be projected based on the policies enacted during his first term, including budget priorities, deregulation efforts, and shifts in environmental governance.
