IN THE NEWS: TEXAS' NEW FIFTEENTH COURT OF APPEALS Just four months in and effective September 1, 2024, the Texas State Legislature now has an intermediate appellate court, the Fifteenth Court of Appeals, for complex business disputes. The new court of appeals will be used for matters that arise from civil cases already within the business court’s jurisdiction including matters brought by or against the state, or state boards, commissions, departments, offices, or other agencies within the state executive branch. Business court cases where a party challenges the constitutionality or validity of a state statute or rule, and where the Attorney General is also a party, will be exclusively heard by the Fifteenth Court of Appeals. Deeds into trusts are pervasive — if a deed into a trust is invalid without the possibility of correction, the effect would be catastrophic to chain of title. TYPES OF DEEDS: Conveying Property Quit claim deeds should never be used to convey property — they are not accepted by a title company as a valid form of conveyance. These types of deeds simply surrender ownership without conveyance language. There are two types of deeds that should be used instead to convey property: Special Warranty Deed – Owner says they own the property and can convey it – relieves seller of protection obligation in case of dispute. General Warranty Deed – Person selling/giving property is stating they are the owner and have clear title to the property. Cassie McGarvey explains further nuances of deeds in her video.
