The 35th Judicial Conference of the U.S. Court of Federal Claims featured a panel on “???????????????????????? ?????? ???????????????? ?????????? ??????????.” Nancie G. Marzulla joined the panel with John F. Anderson, U.S. Magistrate Judge; Clark S. Cheney, Chief Judge, International Trade Commission; Brian E. Ferguson, Winston & Strawn, LLP; Martin F. Hockey, Jr., Deputy Director, Civil Division, U.S. Department of Justice; and Dennis Barghaan, U.S. Attorney, Eastern District of Virginia. In her remarks, Nancie discussed the issue of low economic value cases before the Court: “Our firm handles large, high-dollar, complex cases in this court involving constitutional takings claims, breach of federal contract claims, large class-action back-pay claims, and breach of trust claims on behalf of tribes and their members. However, we also represent clients whose claims seek recovery of significantly lower dollar amounts for a breach of contract or for an unconstitutional taking of their property rights. Last month, Nancie G. Marzulla?moderated the panel “Supreme Court Application of the Canons of Federal Indian Law” at the?35th Annual Judicial Conference of the U.S. Court of Federal Claims. She was joined by panelist?Meredith Harris of the Office of Legal Counsel of the Yakama Nation. As Nancie noted, originally, the canons of Indian Law were seen as rooted in the unique trust relationship between the United States and the Indians. But the modern view is that the canons are seen as protecting the important structural relationships between an Indian tribe and the federal government. Seen through this lens, the canons serve as an important interpretative guide for protecting tribal sovereignty and jurisdiction against federal or state regulatory incursion. Our firm has filed a petition for a writ of certiorari in the?U.S. Supreme Court, asking the Court to review a decision of the First Circuit involving the National Marine Fisheries and Bureau of Ocean Energy Management’s approval of the Vineyard Wind Project off the shores of Nantucket, Massachusetts. Marzulla Law represents a group of Nantucket residents who challenge the adequacy of the federal government’s environmental review of the Project. One of the many questions our clients ask us about bringing a #taking claim in the U.S. Court of Federal Claims is whether their claim can be decided by a jury. Recently The Supreme Court of the United States held that the U.S. Securities and Exchange Commission can no longer impose civil penalties through its administrative proceedings for securities fraud cases because defendants accused of fraud have the right to a jury trial under the Seventh Amendment. Does this holding also apply to takings cases in the CFC?
