This month I had the privilege of speaking at the inaugural Outdoor Industry Association’s Catalyst Conference. Seattle brought the rain, and folks arrived with a whole lot of energy (stoke?) and rain gear! Catalyst was fantastic sustainability conference, highlighting the ways that the outdoor industry has led on issues from climate to chemicals. I learned so much from presenters, including my engaging co-panelists Leah Thomas and Jason Parkin who spoke about authentic communication strategies around sustainability and intersectional environmentalism. A few of my takeaways from the conference: ?? Sustainability is a growth industry, particularly as it merges with compliance and legal. New regulations are pushing businesses to adopt greener practices--what was once cutting-edge will soon become legal requirement. This means that businesses integrating sustainability into design, operations, and marketing can stay ahead of regulatory requirements, foster positive reputations, and contribute to a healthier planet. ?? We can learn so much from the path behind us. I was inspired to sit with and learn from so many historical and present sustainability leaders in the outdoor industry. These innovators have faced challenges, embraced innovation, and driven change that continues to influence sustainability going forward. Their work reminds us that collaboration across disciplines can lead to extraordinary breakthroughs. ?? The value of in-person collaboration cannot be overstated. Technology has made remote work and communication easier than ever—but the electricity of hundreds of sustainability professionals in one room can’t be beat. A big thank you to the OIA team for putting together this event, including Julie M.H. Brown, Keelin Kelly Christensen, Breana Nehls, and Andriana Rogers. I have no doubt that Catalyst will drive change for years to come! #outdoorindustry #sustainability

Next Wednesday James Pollack is hosting a monthly PFAS briefing sponsored by the Environmental Law Institute. This month, the focus of discussion is greenwashing. Green marketing allows consumer product manufacturers to tap into demand for products that have less of an impact on the environment. Over the past several years, green marketing has also shown its potential as a litigation minefield. This form of false advertising, or greenwashing, presents serious litigation risks from the FTC, states, and class action plaintiffs alike. One of the fastest-growing segments of greenwashing litigation has involved PFAS. Want to learn more about regulations pertinent to green marketing? Sign up using the link below! We're happy to share that Marten Law's Kameron Schroeder, Victor Xu, and Richard Allan were able to successfully negotiate the reopening of a trail on the Oregon coast on behalf of the Oceanside Trails Group. The Oceanside Trails Group reached out to Kameron last winter after new owners of a residential property closed a trail. The trail had been used by thousands of residents and visitors over its more than 30-year existence and ran along the south-east side of the new owners property. The trail connected several adjoining neighborhoods and without it the neighborhoods are only connected by vehicle roadways or more remote foot paths. The trail also provides convenient access to a tire trail, the neighborhoods’ only foot path to the beach and ocean which bypasses Highway 31. Kameron, Victor, and Richard traded several letters with the new owners, outlining our clients entitlement to a prescriptive easement over the trail and negotiating a resolution. They were ultimately able to convince the new owners of the expense of litigating the issue in court, and the validity of our client’s legal position. Kudos to everyone who contributed to this success!??????
