The Associated Press highlighted Partner Tiffany Gehrke’s perspective on the recent victory for Penn State in a trademark infringement suit that could have had major implications for brand owners. “It addresses an important issue with trademark law — whether or not the mark owner is able to prevent third parties from using its marks on T-shirts and paraphernalia without permission,” Tiffany told the Associated Press in an interview. The verdict, she said, maintains the status quo, while a victory for Vintage Brand “could have shaken things up.”

Thank you to the Emerging Litigation Podcast’s Tom Hagy for spending time with Ryan N. Phelan to discuss the latest developments in patent eligibility. Tom and Ryan cover a lot of ground in this conversation, including the intricate landscape of patent eligibility in the U.S., the Supreme Court’s perspective, and the proposed Patent Eligibility Restoration Act and how, if it passes, it could unlock new opportunities for innovation amid the challenges posed by judicial exceptions. Law360’s Ivan Moreno recently interviewed Tiffany Gehrke for her input on a highly anticipated trademark trial coming next week. The Pennsylvania State University and Vintage Brands will face off in a trademark suit that puts infringement claims in the spotlight and could significantly impact trademark owners. About the possible outcome, Tiffany told Law360, "If this goes in Vintage Brand's favor, then it will open a door for retailers and fans to basically start creating and selling merchandise in a way that the licensor, the trademark owner, would no longer be able to control.” We will watch the trial closely and look forward to sharing our insights. https://lnkd.in/gZ542zS2
