On March 7, 2025, the U.S. District Court for the Western District of Pennsylvania issued a significant ruling, affirming that the Pennsylvania Human Relations Act (PHRA) does not require employers to accommodate an employee’s use of medically prescribed marijuana. In a case of first impression, the District Court dismissed the plaintiff’s claim that a potential employer unlawfully failed to accommodate his disabilities by rescinding a job offer due to a positive marijuana drug screen. Aligning with the Pennsylvania Commonwealth Court’s decision in Harrisburg Area Cmty. Coll. v. Pennsylvania Hum. Rels. Comm’n, the Court emphasized that the PHRA does not extend protections to medical marijuana use, citing the Act’s explicit exclusion of controlled substances classified as illegal under federal law, including marijuana under the Controlled Substances Act (CSA).
