Chapter 647 of the Laws of Malta is the final step in the integration of the EU’s MiCA Regulation (MiCAR) in the jurisdiction’s legal framework. Act XXXVI of 2024 (promulgated in November 2024) integrates the remaining titles of MiCAR which are applicable as from December 2024 through the introduction of Chapter 647. With effect from July 2026, Act XXXVI also repeals the VFA Act (Chapter 590). Consequently, the amendments made in the VFA Act relating to tokens in the first half of 2024 have been largely replicated in Chapter 647. Like MiCAR, Chapter 647 begins by regulating the issuers of various token types, progresses to service providers (CASPs), and then provides rules on market abuse prevention, regulatory powers, transitory measures, and appeals.
