[Weekly Halachah #59] Mishnah Brurah [1] rules that it is forbidden to play a ball game on the ground out of a concern that the players might flatten the ground. He explains that even Rama, who is lenient, only permits playing ball if not on the ground. Nonetheless, even if children are playing ball on the ground one should not protest because it is better that they violate the halacha unintentionally instead of violating it intentionally (mutav she'yeheyu shogegin v'al yeheyu meyzidin). Rav Alashvilli [2] suggests the same for the opinion of the Shulchan Aruch Harav that playing on the ground would be forbidden. Additionally Rav Chaim Noah [3] writes at length of the multiple concerns with the balls of today together with it not being in the spirit of Shabbos. ?????? ?????????????? ?????? ???????? ?????????????? ???? ??????????????? [Weekly Halachah no. 58] The braiysa [1] forbids carrying an animal on Shabbos. Rashi [2] explains that this is because animals are muktzeh. Maggid Mishnah [3] explains that they are muktzeh because they have no purpose on Shabbos. Rav Chaim the son of Or Zaruah writes [4] that even though animals are muktzeh, birds that make nice sounds in their cage that people enjoy are not muktzeh. this is analogous to the case of a pretty daffodil branch that is not muktzeh due to people enjoying its appearance. [5] Rosh [6] responds that they are indeed muktzeh because they do not have a toras kli. There is more of a reason to assume they are muktzeh, considering that using an animal on Shabbos is prohibited, and Chazal do not distinguish between different types of animals. Some poskim relate this dispute to the dispute as to whether domesticated pets are muktzeh. Similarly, Rabbeinu Yosef holds that a chick is not muktzeh because it is possible for a child to play with it. However, Tosfos [7] rejects this based on a Gemara [8] that implies that chicks are indeed muktzeh. _________________ [1] Gemara Shabbos 128b [2] s.v. ein [3] Hilchos Shabbos 25:25 [4] Maharach Or Zaruah 81 [5] Gemara Shabbos 50b. Rav Elyashiv [Shalmei Yehuda ch. 3 fnt. 66] holds that a flower vase holding flowers in water is not muktzeh, and Rav Ovadia [v. 3 p. 25] agrees. However, Rav Elyashiv is strict and holds flowers potted in soil are muktzeh. Rav Avraham Osdaba of the Beis Din of Crown Heights holds that one shouldn’t move it irrespective of muktzeh rather due to concern of the flowers growing. ???? ?????????????? ??????????????? [Weekly Halachah #57] Although poskim [1] generally assume that garbage is muktzeh, it technically depends on what is thrown out and when it is thrown out. (1) Items thrown out before Shabbos: Rav Elyashiv [2] (based on siman 308:7) explains that items thrown out before Shabbos are usually muktzeh. As long as it is normal to throw out the object as is, like in the case of a used disposable item, it is muktzeh once it was thrown out before Shabbos. [3] Rav Shlomo Zalman Auerbach [4] applies the same logic to food that is thrown into the garbage before Shabbos. He holds that such food is muktzeh because no one would take it out of the garbage, even to feed it to dogs. [5] (2) Items thrown out on Shabbos: The muktzeh status of items thrown out on Shabbos depends on the dispute regarding whether they are muktzeh if used on Shabbos (discussed in 308:11). Even the lenient views are only lenient about items that could theoretically be reused, like used soda cans, plastic bottles, or potato-chip bags. However, all opinions agree that torn wrappers, ice pop sticks, and dirty tissues are all muktzeh. [6] However, leftover food is not muktzeh if it can be fed to animals (as mentioned in siman 308:27). [7] _________________________ [1] Chut Shani [v. 3 p. 160] [2] Shalmei Yehuda [ch. 6 fnt. 60] [3] Rav Ovadia [Chazon Ovadia v. 3 p. 129] agrees. However, The Shabbos Kitchen [p. 339 fnt. 68] quotes Rav Wosner [Kovetz Mbeis Levi v. 19 p. 54] who holds that even disposable items that were thrown out before Shabbos are not muktzeh. He infers that Rav Pinchas Sheinberg agrees with this. [4] Shemiras Shabbos Kehilchasa [ch. 20 fnt. 91] [5] Orchos Shabbos [v. 2 p. 68] agrees. The Shabbos Kitchen [p. 340] writes that if the leftover food in the garbage is not repulsive and would theoretically be removed from the garbage if the need arose, then it is not muktzeh. [6] The Shabbos Kitchen [p. 339]. Rav Nissim Karlitz [v. 3 ch. 51 p. 106] seems to agree. [7] Shalmei Yehuda ch. 6 fnt. 55 quoting Minchas Yitzchak

[Weekly Halachah #56] Rama [1] rules that if someone accidentally leaves money in their pocket before Shabbos, then they may walk with it in their pocket until they reach a safe place where they should then shake it out. His reasoning is that there is no prohibition against moving a muktzeh item after the person had begun moving it before Shabbos, and that the person carrying the money is still actively involved with moving it. Magen Avraham [2] and Shulchan Aruch Harav [3] agree with Rama, whereas Gra[4] disagrees. He holds that it is only permitted to move a kli she’melachto l’isur once it was moved l’tzorech mekomo, as Tosfos and Mechaber in this seif ruled, because the primary prohibition of moving a kli shemelachto l’isur is only violated when it is picked up. If it is picked up for a permissible reason it can be moved anywhere and if not it can’t be picked up. However, moving muktzeh is a violation when it is picked up, moved, and put down. If it was picked up before Shabbos that was permissible, but once it is Shabbos continuing to carry it is forbidden. [5] Mishnah Brurah [6] quotes Derech Hachaim who accepts Rama’s ruling, but only in the case of a pocket with money in it. This is because in such a case, the pocket is not considered a bosis. However, if someone were actually carrying muktzeh coins with their hand at the onset of Shabbos, then they would have to drop them immediately. Shulchan Aruch Harav [7] adds that one must immediately go to the place where they want to leave the money and that they may not linger while still carrying it. Badei Hashulchan [8] writes that one should not remove the money from their pocket by hand; instead, they should shake it out. If that is not possible, then they should remove the clothing containing the money. _________________________ [1] 266:12 [2] 266:19 [3] 266:19. He gives an additional reason because it is titul b’gufo. Shulchan Aruch Harav Im Biurim V’hearos pg. 110 fn. 47 explains that although it is muktzeh gamur, he is allowed to move it because we can presume there is a potential loss, as implied by the wording of Shulchan Aruch Harav 308:13.
