Hello from New Orleans! Jeffrey Himstreet and I attended oral arguments this morning for MFA/NAPFM/Aima’s case against the SEC on its securities lending and short sale reporting rules. We argued that the SEC was arbitrary and capricious in adopting contradictory rules regulating the same market while the SEC tried to explain that the rules were related but not inter-related. The judges asked hard questions of both sides. Thanks to the fantastic job by Jeff Wall and the team at Sullivan & Cromwell LLP, we continue to think our arguments will prevail.
