LPHS Partner Michael K. Hurst recently commented on a Law360 article analyzing existing lawsuits being shifted into Texas’ new business courts. The article found the majority of the 23 cases already in the new system are primarily disputes involving energy or real estate companies. The reason the removal procedures are potentially open to interpretation, Hurst said, comes down to the language in the portion of the statute creating the court that deals with initial filings and removals.
