There is a lot of talk right now about promoting, and even mandating, civility in the legal profession. As an employment mediator, I usually see attorneys at their most civil. Seasoned litigators recognize that civility actually is helpful in the mediation context. While an attorney might believe they can gain an advantage in litigation by being less than civil, the opposite is true in mediation. Mediation necessitates a degree of civility and collaboration, and that sets it apart from the adversarial nature of litigation. An underappreciated reason to settle your employment dispute is to get the parties their time back. "Time is more valuable than money. You can get more money, but you cannot get more time." But people tend to overestimate short-term pain (settling for an amount that is higher or lower than they expected) and underestimate long-term pain (future time spent litigating or even trying the case). By settling, the parties make a financial decision in the present that effectively buys them time and peace of mind in the future.
