Yesterday, a federal judge issued his opinion, confirming his earlier ruling that our client The Intercept's copyright infringement lawsuit against OpenAI can proceed. "To state the conclusion clearly," it reads in part, "even though the specific right created by the [Digital Millenium Copyright Act] may be comparatively new, the injury experienced by The Intercept because of the violation of that right sounds in the same kind of harm long recognized in copyright suits." Loevy partner Matthew Topic, who is leading the litigation, says, “We look forward towards the ultimate resolution of the case, which has important ramifications for all copyright owners.”
