After a two-week liability trial, a Queens jury returned a 100% liability verdict in just 7 minutes—completely in favor of our client. Our client, a woman in her late 50s, slipped and fell on water leaking from an AC unit inside her own convenience deli in Manhattan. She suffered an ankle injury requiring surgery as a result of the fall. The lease agreement placed maintenance responsibility for the AC unit on her, but we successfully argued that certain lease provisions—related to “structure of the tenant space” and “latent defects”—shifted that duty to the property owner. The property owner assumed the responsibility of the defective AC unit due to their actions of inspecting and attempting to fix it on multiple occasions and promising our client that it would be replaced. Michael and Matthew split the trial tag-team style, each handling half the witnesses. In the damages phase, the jury awarded $7 MILLION for pain and suffering alone—not including any recovery for lost income or future medical care. Before trial, the defense offered just $175,000. Minutes before the damages verdict, the offer was increased to $750,000—an offer that was immediately rejected.
