פסק הדין התקדימי שניתן לקיבוצים – כיצד הוא ישפיע על עסקאות נדל"ן? עו"ד דוד ויינשטיין, שותף במחלקה המסחרית במשרדנו, התייחס בכתבה שהתפרסמה בגלובס לפסק הדין ההיסטורי שניתן בשבוע שעבר לטובת הקיבוצים. בית המשפט העליון קבע כי הקיבוצים לא יידרשו עוד לשלם היטל השבחה סביב שיוך של מבני מגורים ומגרשים לחברי הקיבוץ – פסיקה שעשויה להשפיע משמעותית על עסקאות נדל"ן נוספות בקיבוצים. בהתייחסו להשלכות ההכרעה, דוד מסביר כי פסק הדין מעביר מסר ברור בנוגע ליחסים שבין הקיבוצים לחבריהם: ""רשויות המס הניחו בעשור האחרון כי בין הקיבוצים לחברים שלהם מתקיימת מערכת יחסים עסקית. המסר העולה מפסק הדין הוא שיש לבחון את ההוויה הקיבוצית כמות שהיא. זה לא מבטל בהכרח את הגישה העסקית, אבל רוח הדברים שוללת את הגישה הזו.” 🔗לקריאת הכתבה המלאה בגלובס:https://lnkd.in/dStnDGM7
