On January 21, 2025, President Trump issued an Executive Order that eliminates affirmative action requirements for federal contractors, revoking policies in place since 1965. While contractors have a 90-day transition period, the directive immediately halts enforcement of diversity and workforce balancing initiatives. Several organizations have already filed lawsuits challenging the Order, arguing it exceeds executive authority and violates constitutional rights. The U.S. Department of Homeland Security has introduced new regulations aimed at modernizing and improving the H-1B visa program, which allows U.S. employers to hire foreign talent for specialized occupations. These changes, effective January 17, 2025, clarify specialty occupation requirements, streamline the petition process, and introduce new opportunities—such as allowing entrepreneurs to obtain H-1B visas through their own start-ups. The U.S. Department of Labor recently clarified that employers cannot require employees to use accrued PTO while on FMLA leave if they are also receiving benefits from a state or local paid family and medical leave program. Instead, PTO use must be mutually agreed upon between the employer and employee. If your business operates in states with paid leave programs (like CA, NY, WA, etc.), now is the time to review your FMLA policies for compliance. Read more in Samantha J. As we indicated in our?April 2024 E-Alert, earlier this year the FTC issued a Final Rule which would have made nearly all non-compete agreements unenforceable. The Final Rule was slated to go into effect on September 4, 2024. In addition to making most non-competes illegal, the Final Rule required employers to provide written notice to employees who were subject to the offending non-compete agreements. Almost immediately lawsuits were filed opposing the FTC’s Final Rule. Within days, two different lawsuits were filed in Texas and one was filed in Pennsylvania.
