Many people assume that court ordered child support obligations in New York automatically stops at 21—but that’s not always the case. In some instances, support magistrates require a court order to officially end payments. Yes, you read that correctly. Even though the statute is clear that support ends at the age of 21, the obligation may go beyond that age, if you are not proactive. Without a clear end date in the court order, a payor could still be on the hook for back payments, even after the child turns 21. Imagine thinking your obligation is over, only to be taken to court years later for unpaid support. It sounds unreasonable, but it’s happening. The best way to avoid this? Make sure your agreement clearly states a date certain when child support ends and have it “so-ordered” by a judge. Having this date included in a court order, alleviates any possible discrepancies that may arise later. This small step can prevent unexpected financial and legal issues down the road. Divorce and co-parenting already come with enough challenges—uncertainty about child support shouldn’t be one of them.
