Congratulations to attorney Desiree Saad, Esq., who successfully opposed the plaintiffs’ motion for summary judgment as to liability in Queens County Supreme Court in a case involving a rear-end motor vehicle accident.?The plaintiffs sought summary judgment as to liability for an accident allegedly caused by our clients, which resulted in significant personal injuries.?Desiree successfully argued that there were questions of fact as to liability, particularly regarding the actions of the plaintiffs, and that summary judgment based on liability was not warranted.?The Court agreed and denied plaintiffs’ motion.

Congratulations to Jason Katz for obtaining summary judgment and dismissal of the plaintiff’s complaint and all crossclaims asserted against his client in a Labor Law matter pending in Westchester County Supreme Court. The plaintiff was working at a construction site and standing on a platform pumping concrete when he fell to the ground. Plaintiff cited alleged violations of Labor Law sections 240(1), 241(6), 200, and common law negligence. Jason successfully argued that his client was not a proper Labor Law 240(1) or 241(6) defendant, that his client did not create any allegedly hazardous condition or supervise or control the activity that resulted in the plaintiff’s fall, and that it owed no duty to the plaintiff. The Court agreed and dismissed all claims against his client, with prejudice.
