Yesterday, Monica Nelson and I finished up our four-day jury trial before the Honorable Associate Justice Montalbano in Providence Superior Court. The jury of six returned its unanimous defense verdict within two and a half hours. The Plaintiffs brought five claims against our client, Kirkbrae Country Club - breach of contract, breach of the implied covenant of good faith and fair dealing, unjust enrichment, ultra vires, and violation of the R.I. Deceptive Trade Practices Act - all stemming from an alleged failure to follow the by-laws of the Club: Kirkbrae revoked the Plaintiffs’ conditional membership with the Club when it was informed that one of the Plaintiffs had been convicted of conspiracy to commit murder, which was not disclosed on the relevant membership application. Plaintiffs sought compensatory damages consisting of a membership application fee and food and drink costs incurred at the Club. They also sought specific performance in the form of admission to the Club (which would have been considered/determined by the trial justice, but only if the jury had found Kirkbrae liable on any of several certain claims). While Plaintiffs had additionally requested punitive damages under the DTPA and reputational harm damages, these were dismissed by the Court prior to trial via motions by Kirkbrae. We must thank our client, Kirkbrae, for being one of the best clients to work with, and trusting in us to represent them well. Especially Monica, who has been on this case and defended Kirkbrae vigorously since the very beginning of this lawsuit.
