Oh, contracts! A good non-compete I used to write, but write them no more I don’t know about that. Here’s what I do know and you should know too: The FTC has banned all non-competes except in 3 circumstances. First, understand that words like “EMPLOYER” and “WORKER” are LEGAL DEFINITIONS. That means they do NOT mean what you think they mean. Employer is any person (including individual or business). Worker is any employee, independent contractor, volunteer, intern, extern, apprentice, and sole proprietor providing a service to a person. Sounds like it covers everyone and that means you have until September 4, 2024 to remove all non-compete language from contracts and everywhere else. But the FTC goes one step further to require you as an “employer” notify current and former “workers” with current non-competes that they will not be enforced. Say Goodbye to non-competes ???? Don’t wait to review your contracts and all other documents for non-compete provisions. You also need to identify and notify people too. ??? September 4th. Remember the date. Chayla, you mentioned there were 3 circumstances for non-competes to still exist? That’s right, I did. Briefly they are: 1?? Senior executives with current non-competes before the deadline (no more after 9/4/24) FTC has a definition for who qualifies as a senior executive btw. 2?? Buying or selling a business? It is allowed 3?? For non-US workers. The FTC rule is limited to non-competes in the U.S. so non-competes for U.S. workers trying to compete outside the U.S. and non-U.S. workers not working in the U.S. are still on the table. *Check international laws Found this helpful?
