    3rd year English Lit student | Aspiring to enter the legal field

    I had the privilege of attending Lucy Barnes’ inspiring webinar today. Hearing her speak about her journey growing up in foster care to becoming a pupil barrister was both moving and insightful. Through her story and the incredible work of Lawyers Who Care, I’ve gained a deeper understanding of the challenges faced by care-experienced individuals. What resonated most was her openness about the adversity she’s faced which is something not often seen in such a traditionally formal profession like law. Her courage and hard work is truly inspiring. Thank you Lucy 😊

    I heard Lucy Barnes speak last week and have been thinking about what she said for the last week. She really made an impression. She supports Lawyers Who Care. They support care experienced people. I want you to think about how many times you phoned your mum, dad, aunt, uncle etc. for advice about what to put in a letter; how to do something; for their opinion. What if you have a corporate parent and they are done and gone? Please donate to this charity.   • Holly Littlewood Book Launch 🚀 Thrilled to be supporting Spire Barristers very own Holly Littlewood on her book launch taking place in chambers on Thursday 3rd April, from 5:30pm to celebrate. A summary of the book: Chapter 1 of Part 6 of the Equality Act 2010 (“EqA”) renders it unlawful for the responsible body of a school to discriminate against a pupil or prospective pupil on the grounds of his or her disability. A claim for disability discrimination against a school situated in England must be brought in the First-tier Tribunal (SEND) (“the FTT”). The FTT only has jurisdiction to hear disability discrimination claims against the responsible bodies of schools. Claims against the responsible bodies of schools on the grounds of other protected characteristics must be made in the County Court. Claims to the FTT differ from County Court claims in a number of important respects: • Accessibility: the FTT is designed to be accessible to parents and young people who may have limited means, and / or limited access to legal advice or representation. As such, no issue fee is payable to bring a claim to the FTT, and the general rule in the FTT is no order for costs. Further, the FTT seeks to adopt a more informal and “user friendly” approach to proceedings than might be found in the County Court, with the aim of ensuring that parents and young people should not need to engage legal representation. • Procedure: the FTT has its own distinct procedure rules. Further, it operates on an inquisitorial basis, in light of its role as a specialist tribunal. • Remedies: further to a determination of disability discrimination, the FTT has a broad power to order such remedies as it thinks fit, which could include, for example, the reinstatement of a pupil who has been permanently excluded, additional tuition, or policy changes. To this extent, the FTT’s power is more wide ranging than the County Court. However, unlike the County Court, the FTT is unable to order the payment of compensation. The volume of disability discrimination claims brought in the FTT has increased over time, rising from 190 registered appeals in the academic year 2021 / 2022 to 330 registered appeals in the academic year 2022 / 2023 (an increase of over 70 per cent). In light of the significant challenges facing the SEND system in England, it may be anticipated that the number of claims will continue to grow. This book has been written to provide a practical, detailed guide for parties embarking upon, or responding to, a claim in this unique jurisdiction. It addresses the statutory framework and case law (including the definition of disability and the various forms of discrimination), the procedure with respect to bringing or responding to a claim in the FTT, and the framework for challenging a decision of the FTT.     An incredible view for an appropriately incredible evening. “How can we effectively be a voice for care-experienced clients and share their stories in court if we do not yet understand, or give visibility to, care experience? For care-experienced people, access to the profession is access to justice.” Lucy Barnes is a force for good in law, pushing forward Lawyers Who Care's mission to break down barriers for care-experienced aspiring lawyers. Thank you, Lucy, for inviting me to speak at your training event for mentors yesterday evening. It was inspiring to meet so many wonderful people giving their time, skills, and experience to change lives. Unexpected bonus... a catch-up with the fantastic Jane Keenan.
