Important Kentucky Supreme Court Update: The Court's recent ruling in Davenport v. Kindred Hospitals Limited Partnership (2024) significantly impacts how attorneys must calculate filing deadlines for wrongful death and estate negligence claims. The Court held that the one-year statute of limitations begins when the judge signs the Order of Appointment for a personal representative, not when it's entered by the clerk. This ruling means attorneys must implement new mechanisms to track Order signing dates, as relying on Entry dates could result in late filings. The opinion clarifies that KRS 395.105's procedural requirements take precedence over Civil Rules in these matters.
