Whether you are long overdue in developing a Virginia Business Privacy Program or if you want to update your existing Business Privacy Program, now is the time to get started in your 2025 data security and privacy planning. In addition practical considerations, the?Virginia Consumer Data Protection Act?and increased federal regulatory oversight mean each business has increasingly complex data and privacy legal obligations. With this new legal authority, the Virginia Office of Attorney General and federal authorities have stepped up?enforcement actions. And if the legal requirements are not enough, your Virginia or Washington, DC, business needs a Privacy Program to protect your clients, your employees, and your company’s interests from reputational and operational damage. A proactive program, rather than a reactive solution, is the key to navigating these challenges. https://lnkd.in/g5aNZuer

Here's an important practice note from Matthew Cox about Health and Human Services'?proposed update?to HIPAA’s Security Rule. The update to the Security Rule focuses on strengthening cybersecurity protections for electronic protected health information by addressing changes in health care delivery, increased cyberattacks, and observations by the?Office for Civil Rights. The HIPAA Security Rule requires clinics, physicians, hospitals, pharmacies, and other healthcare providers, as well as their business associates (e.g., consultants, subcontractors, billing companies, transcriptionists, and other vendors) to protect patients’ electronically stored protected health information. The Rule requires certain administrative, physical, and technical safeguards to protect the confidentiality and security of patient information. Reach out to our Privacy Practice to learn more about the proposed rule change and how it affects you. https://lnkd.in/eGDec7cj security-rule/

The Federal Trade Commission (FTC)?recently announced?that it will require?Marriott International and its subsidiary Starwood Hotels & Resorts Worldwide to “implement a robust information security program to settle charges that the companies’ failure to implement reasonable data security led to three large data breaches from 2014 to 2020 impacting more than 344 million customers worldwide.” The announcement and penalties serve as a helpful reminder of the risks associated with failing to maintain an adequate?privacy program, which protects a business’s consumers and partners. Just as important, the terms of FTC’s draft settlement agreement with Marriott provide insight into the growing regulatory focus on data minimization in privacy and cybersecurity matters.
