Most of these claims by individuals are FAKE NEWS meant to incite fear and panic among immigrant communities. Yes, some assertions may be well-meaning, but still induce the same effect: fearmongering. That said, one must keep up to date with reliable and cogent information. The Law Office of Edward W. Dispelling Myths About Dual Nationals and U.S. Entry Requirements There's been some confusion regarding dual nationals of the U.S. and other countries, being denied entry into the United States. Let's set the record straight: - U.S. Passport Requirement: All U.S. citizens, including dual nationals, must present a valid U.S. passport when entering or re-entering the United States. Traveling with only a foreign passport or a recently issued U.S. Certificate of Naturalization can lead to boarding denial, trip delays, and unexpected costs until an emergency U.S. passport is obtained. - Legal Obligation: Under Section 215 of the U.S. Immigration and Nationality Act (8 U.S.C. 1185), it is unlawful for a U.S. citizen to enter the United States on anything other than a U.S. travel document. This rule applies to all dual citizens, including infants and children. - Prohibition on Alternative Travel Documents: U.S. citizens cannot use the ESTA Visa Waiver Program or travel on a U.S. visa instead of carrying a valid U.S. passport. - Passport Validity: Always ensure your U.S. passport is valid. The State Department advises renewing passports at least nine months before expiration, as many countries require six months' validity for entry. Travel smart and stay informed. Always carry your U.S. passport when traveling to or from the United States to avoid unnecessary complications.
